Illinois District Court Holds CERCLA Strips Court of Jurisdiction to Hear Equitable Relief Claims Related to CERCLA Site
Ludwig v. Pilkington North America, Inc.
The District Court for the Northern District of Illinois recently held that S 113(h) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), 42 U.S.C. S 9601 et seq., served to strip the court of jurisdiction to hear plaintiffs’ equitable relief claims related to a site already subject to CERCLA cleanup activities.
