California Court of Appeal Affirms Air District Is Immune from Liability for Miscalculating Amount of Farm’s Emission Reduction Credits

California’s Court of Appeal Third Appellate District upheld the trial court’s ruling that the Feather River Air Quality Management District was shielded from liability for an erroneous calculation of emission reduction credits (ERCs). The court found that making calculations was not an “operational task” that could give rise to liability if negligently undertaken.
