Newhall Project Delayed Again by Appellate Court; More Water Supply Analysis Required
Santa Clarita Organization for Planning the Environment et al. v. County of Los Angeles
The United States Court of Appeals for the Ninth Circuit held that a statute limiting the right of property owners to exclude others from their property gives rise to a Fifth Amendment Takings claim and not to a substantive due process claim under the Fourteenth Amendment. Since the property owners had not stated a takings claim in their complaint, the court dismissed their claims.
