In an unusually scholarly opinion, chronicling the history of California land use and dedication policies from 1851 to the present, the Third District Court of Appeal recently held that a landowner may not bar the public from using what remains of the historic Marysville-Nevada road, and that the public has a right-of-way through the Yuba County Goldfields in the approximate location of the historic road.
