Second Circuit Finds Insured Proved Coverage under Lost Policies in Connection with Four New York Waste Disposal Sites

The Second Circuit Court of Appeals has held that an insured proved by clear and convincing evidence on summary judgment that much of its liability arising from four Buffalo, New York area waste disposal sites to which it had shipped waste was covered by lost policies issued in the 1960s and 1970s.
