Another New York Court Finds Indoor Fumes Are Not Subject to the Absolute Pollution Exclusion.

On May 13,2002, the Supreme Court, Appellate Division of New York held that an absolute pollution exclusion provision in an insurance policy does not exclude from coverage a case where a claimant in an underlying action alleges injury caused by temporary indoor dissemination of paint or paint solvent fumes.
