  • Pennsylvania Supreme Court Allows Criminal Conviction of Corporate Employee for Improper Disposal of Waste

    Commonwealth of Pennsylvania v. David R. Packer

    The Pennsylvania Supreme Court has upheld the criminal conviction of a laborer for burying tires on property where the laborer's employer had failed to obtain a permit from the Pennsylvania Department of Environment Resources. The court held that the legislature intended to make not only employers but also employees criminally liable and further held that extending criminal liability to employees is not unconstitutional.
