Third Circuit Vacates Clean Air Act Prison Sentence but Holds Majority of Sentence Enhancements Warranted.
United States v. Chau, Case No. 00-2720
The Third Circuit Court of Appeals vacated and remanded a sentencing decision by the Eastern District of Pennsylvania with regard to Clean Air Act (CAA) asbestos violations because lack of a permit did not justify a four-level sentence enhancement.
