  • New York Court Limits Daily Civil Penalties to Period within Statute of Limitations

    State of New York v. Exxon Corp., 2002 N.Y. Misc.

    On April 1, 2002, the Albany County division of the New York Supreme Court held that statutory civil penalties for gasoline discharges are limited to per-day penalties reaching back no more than three years. In making its decision, the court rejected the argument that the "continuing violation" doctrine tolled the statute of limitations indefinitely.
