Ninth Circuit Holds Federal District Court Proper Forum for Adjudication of Nuclear Waste Policy Act Preemption Issue
United States v. Morros

The United States Court of Appeals for the Ninth Circuit vacated and remanded the District Court's decision to abstain from hearing a complaint filed by the United States alleging that the Nuclear Waste Policy Act (NWPA) preempted a Nevada statute that prevented the siting of a nuclear waste repository in the state.
