Eighth Circuit Reverses Judgment on Issue of Divisibility of Harm Under CERCLA
United States of America v. Hercules, Inc.
Venturing into an issue under the Comprehensive Environmental Response, Compensation and Liability Act, 42 U.S.C.§9601 et seq, called "problematic " by some courts, the Sixth Circuit Court of Appeals has reversed a District Court's refusal to limit joint and several liability under the doctrine of "divisibility of harm."
