Ninth Circuit Upholds Phoenix Federal Implementation Plan Exempting De Minimis PM-10 Sources

In reviewing the federal implementation plan (FIP)for the Phoeniz, Arizona area that was adopted pursuant to the Clean Air Act (CAA), the Circuit Court of Appeals for the Ninth Circuit upheld the U.S. Environmental Protection Agency's (EPA) decision to exempt certain de minimis sources of particulate matter under ten microns in size (PM-10).
